  1. ברוכים הבאים לאתר האינטרנט "חוות ניר- ירקות מהמושב" www.nirfarm.com. האתר מהווה חנות אינטרנטית וירטואלית לרכישה של פירות, ירקות ושאר תוצאת חקלאית על ידי ציבור גולשי האתר. בעלת האתר והמפעילה הבלעדית שלו הינה חברת 'חוות ניר בע"מ' ח.פ 513529495 שמשרדה הרשום נמצא במושב אחיטוב משק 88 (להלן: "האתר" ו/או "החברה").

  2. האתר הינו אתר לממכר פירות, ירקות, שאר תוצרת חקלאית ומוצרים נלווים. ניתן לרכוש כל פריט המופיע למכירה באתר. רכישת הפריטים הינה על פי תנאי האתר ובהתאם לתנאי תקנון זה בלבד (להלן: "הפריטים").

  3. השימוש בתקנון זה בלשון זכר מטעמי נוחות בלבד, האמור מתייחס לשני המינים באופן שווה.

  4. תקנון זה הינו חוזה מחייב בין המשתמש לבין החברה, גלישה באתר ו/או ביצוע שימוש באתר ו/או רכישה באמצעות האתר מהווה הסכמה מלאה של התקנון וכלל הוראותיו. המבצע פעולה באתר מצהיר כי הוא מודע להוראות התקנון ומקבל אותם במלואם וכי לא תהא לו ו/או למי מטעמו כל טענה ו/או תביעה כנגד החברה ו/או בעלי האתר ו/או מפעילי האתר ו/או מי מטעמם בכל הקשור להפרת התחייבויותיו על פי תקנון זה וכלליו.          יובהר כי "משתמש" הינו כל אדם, יחיד או רבים, לרבות חברה רשאי העושה שימוש באתר.

  5. החברה שומרת לעצמה את הזכות לשנות את תנאי השימוש באתר בכל עת ככל שתראה זאת לנכון.

  6. הרכישה באתר אפשרית ומותרת לכל משתמש שהוא בן 18 שנים ומעלה, אזרח ישראלי ו/או תושב ו/או בעל היתר שהייה חוקי בישראל, בעל כרטיס אשראי בתוקף. במקרה של משתמש קטין ו/או משתמש אשר מונה לו אפוטרופוס בדין עליו לקבל את הסכמת האפוטרופוס להוראות תקנון אלו במלואן. כל פעולה אשר תבוצע על ידי קטין ו/או מי שמונה לו אפוטרופוס בדין מהווה הסכמה מלאה של האפוטרופוס.

  7. החברה שומרת לעצמה את הזכות להפסיק את השימוש באתר למשתמש אשר לא יעמוד בתאי השימוש המפורטים בתקנון זה ואף שומרת לעצמה הזכות לעדכן את תנאי השימוש מעת לעת, בהתאם לשיקול דעתה וללא צורך במסירת הודעה מוקדמת על כך. למען הסר ספק יובהר כי הנוסח הקובע הינו הנוסח המפורסם באתר האינטרנט.

  8. הרכישה באתר אפשרית 24 שעות ביממה 7 ימים בשבוע, על אף האמור ייתכן והאתר יהיה מושבת עקב תקלות שאינן בשליטת החברה אשר עלולות להתרחש בכל עת או בשל עבודות תחזוקה יזומות או מכל סיבה אחרת, למשתמש לא יהיו כל טענות כנגד החברה ו/או מי מטעמה בשל האמור בסעיף זה. החברה רשאית להפסיק בכל עת את פעילות האתר במלואה או חלקית לפי שיקול דעתה וללא כל צורך בהודעה מוקדמת על כך מבלי שלמשתמש יהיו טענות בגין כך נגד החברה ו/או מי מטעמה.

  9. טרם ביצוע פעולה כלשהי באתר מתבקש המשתמש, בעיון, לקרוא את תנאי שימוש באתר לרבות מדיניות הפרטיות, השימוש באתר מהווה הסכמה לכל תנאיו.

  10. באתר מוצעים מוצרים שונים למכירה, חלקם מוצרים עונתיים, החברה שומרת לעצמה את הזכות להסיר מוצרים מסוימים ולהפסיק מכירתם, כמו כן להוסיף מוצרים חדשים ולשנות את מגוון המוצרים המוצעים למכירה באתר זאת בהתאם לשיקול דעתה של החברה וללא כל צורך בהודעה מראש. למשתמש לא תהא כל טענה כלפי החברה ו/או מי מטעמה לעניין סעיף זה.

  11. לצד כל מוצר באתר מופיע מחירו כולל מע"מ כחוק, למעט מוצרים אשר אינם חייבים במע"מ על פי חוק. המועד הקובע לעניין המחיר הוא מועד הכנת ההזמנה על ידי החברה ולא מועד ביצוע ההזמנה על ידי המשתמש ולכן יתכנו שינויים בין מחיר ההזמנה לבן המחיר הסופי בו יחויב המשתמש. חלק מהמוצרים מחירם נקבע לפי משקל החברה תעשה ככל יכולתה לדאוג שהמשקל המבוקש הוא המשקל שיסופק, אולם מטבע הדברים תיתכן סטייה סבירה בין המשקל שהוזמן לבין המשקל בפועל, העלות הסופית הינה של המוצר הינה לפי המשקל שסופק בפועל ולא המשקל שהוזמן על ידי המשתמש, למשתמש לא תהא כל טענה כלפי החברה ו/או מי מטעמה בשל סעיף זה.

  12. החברה שומרת לעצמה את הזכות לעדכן מחירים מעת לעת ללא צורך בהודעה מראש.

  13. המשתמש מצהיר כי ידוע לו שמאחר ומדובר בתוצרת חקלאית טרייה ייתכנו שיניים בזמינות המוצרים בהתאם לעונה וזמני הקטיף וכי לא תהא למשתמש כל טענה ו/או דרישה כלפי החברה לעניין סעיף זה.

  14. המשתמש מצהיר כי הינו מודע לכך שהתמונות באתר הן להמחשה בלבד.

  15. ייתכן כי מוצר שהוזמן על ידי המשתמש חסר זמנית במלאי, במצב זה החברה תיצור קשר עם המשתמש על מנת להודיע לו כי המוצר שהוזמן חסר, במידת האפשר תציע לו מוצר חלופי הנמצא במלאי ובמידה ולא סופק למשתמש כל מוצר חלופי יבוטל החיוב בגין המוצר החסר. למשתמש ו/או מי מטעמו לא תהא כל טענה כנגד החברה בעניין סעיף זה.

  16. ניתן לשלם באמצעות כרטיס אשראי בלבד.

  17. לביצוע התשלום יש לבחור בתשלום, להזין את פרטי כרטיס האשראי ופרטים אישיים (כתובת מדויקת, מייל, טלפון) ובמידת הצורך פרטים נוספים הנדרשים לביצוע החיוב.

  18. חיוב כרטיס האשראי מבוצע ישירות באמצעות שירותי הסליקה של חברת GROW שהינה בעלת מערכת מתקדמת ובטוחה לסליקת כרטיסי אשראי.

  19. בתום ביצוע התשלום יקבל המשתמש, לכתובת הדואר האלקטרוני אותה הזין, אישור בדבר פרטי ההזמנה אותה ביצע, אישור סופי יינתן לאחר בדיקת כרטיס האשראי על ידי חברת האשראי, אישור העסקה על ידי חברת האשראי וחיוב העסקה בפועל. במקרה שבו חברת האשראי לא אישרה את העסקה באפשרות המשתמש לפנות לשירות הלקוחות של החברה להסדיר את התשלום, אחרת ההזמנה תבוטל.

  20. הרישום באתר יהווה ראיה חלוטה לנכונות הפעולות, לעומת זאת משלוח הודעות מטעם האתר באמצעות הדואר האלקטרוני לא יהווה ראיה חלוטה לנכונות הפעולות לכל דבר ועניין ולא יחייבו את האתר.

  21. המשתמש מתחייב להזין אך ורק את פרטיו האישיים האמיתיים הנכונים ולא להזין פרטים השייכים לכל גורם או צד ג', לרבות שמו, כתובתו, כתובת הדואר האלקטרוני שלו, טלפון, טלפון נייד וכל פרט אחר אשר יידרש ממנו בעת ביצוע הרכישה וההזמנה באתר. במקרה של הזנת פרטים שאינם של המשתמש החברה רשאית להפסיק את הליך הרכישה באופן מידי וללא כל הודעה מוקדמת, וכן תהא רשאית לסרב לספק את המוצרים שנבחרו על ידי המשתמש.

  22. החברה רשאית לבטל עסקה או הזמנה בכל מקום בו נפלה טעות סופר או שגיאה לעניין מחירו של המוצר, זמן אספקתו או כל טעות אחרת. מיד עם היוודע דבר הטעות תפעל החברה ללא דיחוי לתיקון הטעות ותיידע את המשתמשים שרכשו את המוצרים בדבר הטעות. למשתמש באתר לא תהא כל טענה ו/או דרישה כנגד החברה בגין סעיף זה.

  23. המשתמש משחרר את הנהלת האתר והשימוש באתר כמו שהוא מאחריות בכל הנוגע לחוסר שביעות מהאתר עצמו, התרופה היחידה תהא לחדול מגלישה באתר.

  24. במקרה של שימוש זדוני באתר ו/או שימוש רשלני או כל שימוש פוגע אחר של משתמש או מי מטעמו יהיה על המשתמש לשפות את החברה ו/או מי מטעמה בגין כל נזק או הפסד שנגרם כתוצאה משימוש רשלני זה, לרבות שכ"ט עו"ד והוצאות משפט.

  25. הנהלת האתר אינה אחראית ולא תישא באחריות בגין כל הפרעה ו/או תקלה ו/או עיכוב במחשבי המשתמש.

  26. השימוש באתר כפוף לדיני מדינת ישראל וחוקיה, במקרה של סכסוך או מחלוקת משפטית בקשר עם תנאים אלו, תהא הסמכות נתונה לבית המשפט המוסמך בחדרה, ישראל.

The products will be delivered within the territory of the State of Israel and in accordance with the detailed distribution areas: The distribution areas are limited to the localities between Herzliya in the south and Haifa in the north. Orders outside the distribution areas will be canceled unless otherwise agreed upon by telephone with the company representative.

  3. When ordering the products, shipping fees of NIS 0 will be added to the order.

  4. The Company reserves the right to limit and/or change its policy regarding sending orders and/or shipping fees and/or limiting the areas to which orders are sent without the User having any claim and/or demand against the Company in respect of this section.

  5. In any case where it is not possible to make the delivery, whether due to an area with limited access from a security perspective or an incorrect address, the Company will contact the User to coordinate an alternative delivery date. In any case, the Company is not responsible for any delay or delay in delivery that originates in a case of force majeure, or a delay that originates from circumstances that are beyond the Company's control (for example: fire, roadblocks, etc.).

  6. The company reserves the right to require the user to be present at the time of delivery and to present an ID and/or credit card.

  7. Deliveries are made on Wednesdays, Thursdays, and Tuesdays only, depending on delivery availability. A company representative will contact you shortly after the order is placed and provide you with the exact delivery date.

  8. At this stage, the distribution areas are limited to the communities between Herzliya in the south and Haifa in the north. Orders outside the distribution areas will be canceled unless otherwise agreed upon by phone with a company representative.

  9. If the customer is not present at the delivery address when the delivery is made, the order will be left at the door of his house and/or at another point agreed upon with the customer. The customer will be informed that the order has been left at this point immediately upon leaving it there. It is the customer's responsibility to collect the order without delay, due to, among other things, their perishable nature.

  10. In the event that the order was left at a point agreed upon with the orderer and with his knowledge, the company reserves the right not to be responsible in the event of theft or loss of the order.

Cancellation

  1. Cancellation of a transaction will be made in accordance with and subject to the provisions of the Consumer Protection Law, 5741-1981 (hereinafter: "the Law") by way of replacing the product with a product of equivalent value or a monetary credit. Cancellation of a transaction from the moment the order is placed until 24 hours before the delivery date will be made by contacting the company by telephone and the user will be entitled to a full credit for the transaction.

  2. In accordance with the Consumer Protection (Transaction Cancellation) Law, 5771-2010, it is not possible to cancel a transaction or return products that are "perishable goods", such as fruits and vegetables that are perishable products, unless a material defect was discovered in them upon receipt of the order.

  3. In the event that the product received by the user is defective, he must contact the company immediately and within 24 hours of the order being delivered for investigation or credit if necessary.

privacy

  1. The company attaches great importance to the security of the information contained on this site and respects the privacy of its users, and therefore the site was built with an emphasis on the rules of information security and privacy on the Internet.

  2. The personal information provided at the time of ordering will be used for the purpose of delivering the products and establishing contact only. The company undertakes not to transfer its customers' information to third parties, except for the clearing and/or distribution company.

  3. Information security - The site is secured using the SSL protocol, credit card information is not stored in the company's systems but is processed by a certified DSS and PCI standard clearing provider.

  4. Direct mailing - The company will send updates or promotions via email, WhatsApp, SMS and the user's social networks only if the user has given their express consent to this at the time of registration. At any stage, the user can remove themselves from the mailing list.

  5. The Company takes all reasonable precautions to maintain the security and confidentiality of information provided by users. However, in the event of force majeure and events beyond the Company's control, the Company's management and/or anyone on its behalf will not be liable for any damage, whether direct or indirect, caused to users.

  6. The intellectual property rights on the site are the exclusive property of the company and under its exclusive control.

  7. According to the Privacy Protection Law, 5741-1981, every person has the right to review the information held about them in a database. A user who finds that the information needs to be corrected is required to contact customer service via email nirfarm16@gmail.com.

Product Supply Policy - Nir Farm

1. General Nir Farm ensures that the freshest agricultural produce is delivered directly from the field to the customer's home. The delivery of the products will be carried out in accordance with the terms detailed below.

2. Distribution areas and delivery times

  • Deliveries are made to coastal communities, between the Herzliya line and the Haifa line.

  • Distribution days are Wednesday, Thursday, and Friday of each week.

  • The product will be delivered within 3 business days from the date the transaction is approved by the credit company, or on the distribution day closest to the order date (whichever is later).

3. Shipping method

  • Delivery is carried out by a courier on behalf of the farm or an external distribution company to the customer's doorstep.

  • The shipping cost will be indicated at the time of purchase and will be added to the total price of the order.

4. Warranty and Disclaimers

  • Nir Farms and/or the website will not be held responsible for delays in the delivery of products as a result of events beyond their control, such as: strikes, shutdowns, computer or telephony system malfunctions, force majeure events, acts of hostility or emergencies.

  • Likewise, the farm will not be responsible for any delay resulting from the customer's failure to respond to the shipment coordination or from providing incorrect contact information.

  • Delivery carried out by a third party will be subject to the terms of the distribution company, and the company will not be responsible for delays resulting directly from the third party.
